Build Bonus

The Patch, Wollert

This program applies to lots where a land contract and a building contract are entered into after 3 June 2020 and prior to 15 July 2020 (settlements may occur after that date), and only to new purchasers of a House and Land Package.  

  1. Completion of a Referral Form is deemed acceptance of these terms and conditions.
  2. To qualify for the Build Payment the Builder must strictly comply with the Builder Relationship Deed and these terms and conditions.
  3. The referral form must be submitted online at jindingdevelopment.com.au. Forms submitted otherwise will not be accepted and will be deemed invalid.
  4. Your referred client(s) must be a ‘new purchaser’ and must enter into both a legally binding contract with the land owner and a legal binding building contract with the Builder after 3 June 2020 and before 15 July 2020 for a House and Land Package at The Patch, Wollert
  5. The Build Payment will be paid by JD Wollert Bodycoats Developments Unit Trust to the Builder as soon as reasonably practicable after the Builder provides photographic evidence or certification by the building surveyor named in the Building Contract that the slab for the Dwelling has been completed (to the Vendor’s absolute satisfaction).

Harriott at Armstrong Creek

This program applies to lots where a land contract and a building contract are entered into after 3 June 2020 and prior to 15 July 2020 (settlements may occur after that date), and only to new purchasers of a House and Land Package.  

  1. Completion of a Referral Form is deemed acceptance of these terms and conditions.
  2. To qualify for the Build Payment the Builder must strictly comply with the Builder Relationship Deed and these terms and conditions.
  3. The referral form must be submitted online at jindingdevelopment.com.au. Forms submitted otherwise will not be accepted and will be deemed invalid.
  4. Your referred client(s) must be a ‘new purchaser’ and must enter into both a legally binding contract with the land owner and a legal binding building contract with the Builder after 3 June 2020 and before 15 July 2020 for a House and Land Package at Harriott at Armstrong Creek.
  5. The Build Payment will be paid by JD Armstrong Creek 1 Pty Ltd to the Builder as soon as reasonably practicable after the Builder provides photographic evidence or certification by the building surveyor named in the Building Contract that the slab for the Dwelling has been completed (to the Vendor’s absolute satisfaction).

Octave at Junction Village

This program applies to lots where a land contract and a building contract are entered into after 3 June 2020 and prior to 15 July 2020 (settlements may occur after that date), and only to new purchasers of a House and Land Package.  

  1. Completion of a Referral Form is deemed acceptance of these terms and conditions.
  2. To qualify for the Build Payment the Builder must strictly comply with the Builder Relationship Deed and these terms and conditions.
  3. The referral form must be submitted online at jindingdevelopment.com.au. Forms submitted otherwise will not be accepted and will be deemed invalid.
  4. Your referred client(s) must be a ‘new purchaser’ and must enter into both a legally binding contract with the land owner and a legal binding building contract with the Builder after 3 June 2020 and before 15 July 2020 for a House and Land Package at Octave at Junction Village.
  5. The Build Payment will be paid by Junction Village Unit Trust to the Builder as soon as reasonably practicable after the Builder provides photographic evidence or certification by the building surveyor named in the Building Contract that the slab for the Dwelling has been completed (to the Vendor’s absolute satisfaction).

Builders Link Referral Program

1.Definitions

  • ‘Builder Representative’ means a representative of a licensed building company.
  • Developer’ means Jinding Developments Pty Ltd or its related entities responsible for developing the Communities.
  • ‘Claim Form’ means the online referral payment claim form made available at jindingdevelopments.com.au.
  • Community’ means the development project being carried out by the Developer at one of Harriott at Armstrong Creek, The Patch Wollert or Octave Junction Village.
  • Contract of Sale’ means the Contract of Sale between the vendor and purchaser relating to
  • the Lot.
  • ‘Estate Manager’ means the red23 sales manager appointed to sell Lots at the Community.
  • ‘Lot’ means a lot in a eligible Community that is available for purchase during the Period.
  • ‘Period’ means the period which commences on 9:00 am on 1 July 2020 and ends on 5:00 pm on 31 December 2020.
  • ‘Prospective Purchaser’ means a natural person over the age of 18 years who is referred to the Community by the Builder Representative through the Referral Form but excludes a person who, in the reasonable opinion of the Estate Manager does not already exist in the project enquiry database at the time the referral is received by the project Estate Manager and has not been referred to a Community by any other party or is a nominee under an existing Contract of Sale or on-sale.
  • ‘Referral Form’ means the online referral form made available at jindingdevelopments.com.au.

2. Subject to Clause 3 below, if the Builder Representative introduces a Prospective Purchaser to a Community and such introduction results in the Prospective Purchaser:

  • entering into a Contract of Sale for the purchase of a Lot during the Period; and
  • paying a 5% deposit,

the Developer will pay to the Builder Representative $2,000 to an account nominated by the Builder Representative within 30 days of receiving a completed Claim Form.

3. A Builder Representative will only be entitled to a payment under Clause 2 if:

  • the full 5% deposit is paid by the Prospective Purchaser;
  • the Builder Representative has submitted a completed Referral Form and submits a completed Claim Form within 60 days of the exchange of the Contract of Sale; and
  • the Referral Form is received and acknowledged by the Estate Manager prior to the Prospective Purchaser entering into a Contract of Sale.

3. A Build Representative will only be entitled to a payment under clause 2 if;
a) Builder Representative has submitted the referral through the referral form at jindingdevelopments.com.au and submits the claim form at jindingdevelopments.com.au within 60 days of unconditional contract exchanged and 5% deposit paid

4. Other terms

This promotion cannot be used in conjunction with any other offer without the Developer’s approval.

The Builder Representative acknowledges and agrees that the Developer shall not be liable to the Builder Representative for:

late, lost, misdirected, incomplete or incorrect Referral Forms or Claim Forms;

any financial or legal implications (or otherwise) that may arise from the Builder Referral Program.

The Developer reserves the right to review, change or discontinue this Builder Referral Program at any time.

The Developer reserves the right, at its absolute discretion, not to accept a referral.

Where a Potential Purchaser is referred by more than one Builder Representative, only the first Builder Representative making the referral (based on the time and date that the Estate Manager receive a completed Referral Form, determined by the Developer in its absolute discretion) will be entitled to the $2,000 referral fee.

To the extent permitted by law, under no circumstances will the Developer be liable to the Builder Representative or Potential Purchaser for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Builder Representative’s and the Potential Purchaser’s participation in this promotion, even if the Developer has been advised of the possibility of such damages.

These terms and conditions are governed by the laws of the state of Victoria.

By submitting this form, both the referrer and the referred person agree to the provided terms and conditions, and agree to Jinding Australia using your personal information in relation to the builder referral program and to promote its products and services. If you no longer wish to receive promotional information from Jinding Australia, you may advise Jinding Australia of your wish. The Jinding Australia Privacy Policy contains information about how you may send your request to Jinding Australia.
